Terms & Conditions • Master Services Agreement
Governing all commercial ad films, wedding cinema archives, creative network commissions, and theatrical distribution across FLICKUS, FLICKER FRAME FILMS, DAYNIGHT MEDIA, ELEVEN STORY, and CINEMA PARADISE.
01.Scope of Production & Directorial Authority
All creative commissions, film scripts, storyboards, cinematography calls, and DaVinci color grading pipelines are executed under the directorial supervision of FLICKER FRAME FILMS, DAYNIGHT MEDIA, and ELEVEN STORY (operating under FLICKUS). The creative director reserves final artistic authority on color science, camera framing, sound design, and edit rhythm in accordance with the signed treatment deck.
02.Custom Pricing, Milestone Payments & Retainers
Services are billed on a custom-scope basis per production agreement. A standard 50% mobilization advance is required to lock production shoot dates and reserve crew/camera inventory. The final 50% balance is payable upon approval of the preview master watermarked cut, prior to final uncompressed Prores/RAW master delivery.
03.Intellectual Property, Licensing & Master Deliverables
Full commercial broadcasting and exhibition licenses are transferred to the commissioning client upon 100% receipt of final payments. FLICKUS and its production divisions retain the perpetual, non-exclusive right to utilize excerpts, keyframes, trailers, and behind-the-scenes material for studio showcase, award submissions, and promotional reels.
04.RAW Footage Archive & Storage Policy
Production RAW files (8K/4K Cinema DNG/ProRes/Log) are securely maintained in our RAID 10 NVMe server arrays for 60 calendar days post-project delivery. Long-term archival and hard-drive handoffs must be contracted separately prior to shoot commencement.
05.Cancellation, Rescheduling & Force Majeure
If a shoot is cancelled or postponed within 7 calendar days of the call sheet date, the mobilization advance is retained to cover pre-allocated crew day-rates and rental reservations. Rescheduling due to weather or natural circumstances will be reassigned to the earliest mutually available date without penalty.
06.Community & Creator Network Guidelines
Creators registered under the OBSCURA network agree that all portfolio reels submitted for verification represent their authentic directorial or technical work. Verified status may be revoked immediately if uncredited or unauthorized third-party footage is presented as original material.
